1/16/16: From a Full Commission ruling: "Based upon a preponderance of the competent testimony and evidence, the FCE with Mr. Arab is reasonable medical treatment designed to effect a cure, provide relief, or lessen the period of disability. Plaintiff has failed to provide sufficient, competent evidence of a justifiable reason for his refusal to attend the FCE with Mr. Arab. Plaintiff has further failed to prove by a preponderance of the evidence that a change to another physical therapist at another facility is reasonably necessary.
11/15/15: From a ruling from Deputy Commissioner Sink: Mr. Arab is licensed by three different governing bodies in the performance of functional capacity evaluations, has 17 years of experience, and has performed over 4000 FCEs. The undersigned finds Mr. Arab is qualified to perform Plaintiff's functional capacity evaluation.
